These Terms & Conditions ("Terms") govern your use of zclabs.org and your participation in the ZC Labs Alerts text message program, both operated by ZC Labs LLC, doing business as ZC Labs ("ZC Labs", "we", "us"). By using the site or enrolling in ZC Labs Alerts you agree to these Terms and to our Privacy Policy.
1. SMS Terms (ZC Labs Alerts)
1.1 Program description
ZC Labs Alerts is a recurring automated text message program operated by ZC Labs. When you opt in, ZC Labs sends marketing text messages that may include news, restock alerts, member offers and account updates. Messages may be sent using an automatic telephone dialing system.
1.2 How to opt in
You can opt in by entering your mobile number and checking the unchecked consent box on the sign-up form at zclabs.org/sms. After you submit the form, you will receive a single text asking you to reply YES. Your enrollment is complete, and marketing messages begin, only after you reply YES. If you do not reply YES, you will not receive marketing messages.
Consent to receive marketing text messages is not a condition of purchasing any goods or services from ZC Labs.
1.3 Message frequency
Message frequency varies. ZC Labs Alerts sends a maximum of 6 marketing messages per month. Confirmation, HELP and STOP replies are sent only in response to your own messages and do not count towards that limit.
1.4 Cost
Message and data rates may apply. ZC Labs does not charge you for text messages, but your mobile carrier's standard messaging and data charges apply to every message sent or received. Check your plan with your carrier.
1.5 How to opt out
Reply STOP to any message from ZC Labs to cancel. You will receive one final text confirming that you have been unsubscribed, and no further messages will be sent. You can also opt out with the web opt-out form or by emailing support@zclabs.org with the number to remove. Opt-out requests are honoured within 10 business days and normally far sooner. If you opt out and later want to rejoin, sign up again at zclabs.org/sms or reply START.
1.6 How to get help
Reply HELP to any message for program information, or email support@zclabs.org.
1.7 Eligibility
ZC Labs Alerts is available to US mobile numbers only. You must be at least 21 years old and must be the account holder, or have the account holder's permission, for the mobile number you provide. By opting in you confirm that both statements are true.
1.8 Carriers
Supported carriers include AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, Boost Mobile, Metro by T-Mobile, Cricket Wireless, Google Fi and others. Carriers are not liable for delayed or undelivered messages. Message delivery depends on effective transmission by your wireless service provider and is outside our control.
1.9 Number changes
If you change or give up your mobile number, you agree to opt out by replying STOP or by contacting us before the change takes effect, so that we do not text the number's next owner.
1.10 Privacy of SMS data
Our Privacy Policy explains what we collect when you opt in and how we use it. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
1.11 Changes to the program
We may suspend or end ZC Labs Alerts at any time. We may change these SMS Terms by posting an updated version here; material changes will be notified to subscribers by text message before they take effect. Continued participation after a change constitutes acceptance.
2. Use of this website
zclabs.org publishes general health information. Everything on it is provided for informational purposes only and is not medical advice. See our editorial standards and medical disclaimer. No goods or services are sold on this website.
You agree not to misuse the site or its forms, including by submitting phone numbers that you are not authorised to use, by automated or bulk submission, or by attempting to interfere with the site's operation.
3. Intellectual property
The content of zclabs.org, including text and design, belongs to ZC Labs LLC or its licensors. You may read, link to and quote it with attribution. You may not republish substantial portions without written permission.
4. Disclaimer of warranties
The site and ZC Labs Alerts are provided "as is" and "as available" without warranty of any kind, express or implied, including any warranty of accuracy, completeness, fitness for a particular purpose, or uninterrupted availability. We do not warrant that any text message will be delivered or delivered on time.
5. Limitation of liability
To the fullest extent permitted by law, ZC Labs LLC and its officers, members and agents will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or participation in ZC Labs Alerts, including carrier charges or delayed or undelivered messages. Nothing in these Terms limits any liability that cannot be limited by law.
6. Governing law
These Terms are governed by the laws of the State of South Carolina and applicable United States federal law, without regard to conflict-of-law rules.
7. Changes to these Terms
We may update these Terms from time to time. The current version, with its "last updated" date, is always available at zclabs.org/terms.
